But there’s more to it than that…

Have you ever been to a place of business and received bad service? Sure. It happens everyday. People receive bad service. Big deal. But what happens when it’s more than bad service, when you’re completely denied service of your physical attributes, one of the reasons protected by law. That still happens even in this day and age.

Here are a few scenarios I’ve seen. You’re given an excuse on why you can’t get service. You need a reservation. You need a parent to accompany you if you’re a minor. The restaurant ran out of the food you want and no substitution can be made. No service animals are allowed. I’m sure there are even more excuses to deny services. People that discriminate are creative.

So you’ve been given illegitimate excuse for why you can’t be served, what do you do about it? Whatever you do, don’t get angry. If you do, you will have given the business a legitimate reason not to serve you. Keep your cool. Leave and calmly file a charge of accommodations discrimination. In Arizona, the Attorney General investigates and you can file a charge of accommodation discrimination online.

Once the charge is filed, the AG offers the business a chance to mediate. If not resolved by mediation, an investigation ensues. If the business excluded you because of a rule be prepared to explain how you complied with the rule, yet still received no service. Look for comparators.The business will have to explain how it did not discriminate.Be prepared for the investigation to take months.

When investigation is concluded, you’ll receive your right to sue. Now you’re in a position to do something about what happened. Take your right to sue and file a lawsuit. May good always prevail over evil.
